End User License Agreement

1.Parties

This agreement is between you and NodeSpec LLC, not Apple Inc. ("Apple"). NodeSpec LLC, not Apple, is solely responsible for the App and its content.

2.License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

You may not copy, modify, reverse engineer, decompile or create derivative works of the App, except as the law expressly allows.

3.Use of our Services

The App connects to our servers and infrastructure services. Your use of those services is governed by our Terms of Service and Privacy Policy.

4.Maintenance and support

NodeSpec LLC is solely responsible for maintenance and support of the App. Apple has no obligation to provide any maintenance or support services for the App. Contact us at [email protected].

5.Warranty

To the extent any warranty applies by law, if the App fails to conform to it you may notify Apple, and Apple will refund the purchase price of the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, as limited by our Terms of Service.

6.Product claims

We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.

7.Intellectual property claims

If a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.

8.Legal compliance

You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

9.Third-party terms

You must comply with applicable third-party terms when using the App, for example the terms of your wireless data provider.

10.Third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of this agreement. Once you accept it, Apple has the right to enforce it against you as a third-party beneficiary.
